اسلام آباد(پاک نیوز) العزیزیہ سٹیل ملز ریفرنس میں سزا کیخلاف نواز شریف کی درخواست پر سماعت 7 اکتوبر تک ملتوی کر دی گئی۔ اسلام آباد ہائیکورٹ نے ریمارکس دیئے کہ دیکھنا ہوگا جج ارشد ملک کے بیان اور پریس ریلیز کا اپیل پر کیا اثر پڑے گا ؟۔ اسلام آباد ہائیکورٹ کے جسٹس عامر فاروق اور جسٹس محسن اختر کیانی پر مشتمل ڈویژن بینچ نے کیس کی سماعت کی۔ نواز شریف کے وکیل خواجہ حارث نے کہا اپیل کی فائل پر بہت سی دستاویزات زیادہ اور کچھ پر کم ہیں۔ جسٹس عامر فاروق نے کہا آپ کو تمام دستاویزات دی جائیں گی۔وکیل خواجہ حارث نے دلائل دیتے ہوئے کہا سابق جج ارشد ملک کا بیان حلفی، پریس ریلیز کی نقول درکار ہیں۔ جسٹس عامر فاروق نے کہا ارشد ملک کا بیان اور پریس ریلیز نواز شریف کی اپیل کا حصہ ہے، لاہور ہائی کورٹ نے بھی بیان حلفی مانگا تھا، ارشد ملک کا بیان حلفی اصل فائل کا حصہ ہے۔نواز شریف کے وکیل خواجہ حارث نے کہا میڈیا میں تو کافی کچھ آتا رہا مگر اصل بیان حلفی دیکھنا چاہتے ہیں، 3 ماہ میں سزا کے خلاف اپیل پر دلائل مکمل کروں گا، جج ارشد ملک کیس میں سپریم کورٹ نے ہمیں نہیں سنا، جج ارشد ملک کیس میں سپریم کورٹ سے رجوع کریں گے، ارشد ملک کیس سے انصاف فراہمی کا پورا نظام متاثر ہوا۔ اسلام آباد ہائیکورٹ نے فریقین کو ارشد ملک کے بیان سمیت تمام دستاویزات فراہم کرنے کا حکم دے دیا۔یاد رہے احتساب عدالت نے 24 دسمبر 2018 کو العزیزیہ ریفرنس میں نواز شریف کو 100 سے زائد سماعتوں کے بعد 7 سال قید بامشقت اور جرمانے کی سزا سنائی۔ یکم جنوری 2019 کو نواز شریف نے فیصلہ کالعدم قرار دینے کے لیے ہائی کورٹ سے رجوع کیا تو نیب نے فیصلہ چیلنج کرتے ہوئے سزا بڑھانے کی اپیل دائر کر دی۔نواز شریف نے اسلام آباد ہائیکورٹ میں طبی بنیادوں پر سزا معطلی کی درخواست دی جو مسترد کر دی گئی لیکن سپریم کورٹ نے عبوری ریلیف دیتے ہوئے طبی بنیادوں پر سزا 6 ہفتوں کے لیے معطل کر دی۔ 6 ہفتے پورے ہونے کے بعد ضمانت میں توسیع کی استدعا مسترد ہوئی اور سابق وزیراعظم کو ایک بار پھر جیل جانا پڑا۔نواز شریف نے 20 مئی کو اسلام آباد ہائی کورٹ میں طبی بنیادوں پر سزا معطلی کی ایک اور درخواست دائر کی جو 20 جون کو خارج کر دی گئی۔ اسی دوران نواز شریف کو سزا دینے والے احتساب عدالت کے جج ارشد ملک کے خلاف وڈیو سکینڈل سامنے آیا۔ ارشد ملک نے اپنی صفائی میں پہلے پریس ریلیز جاری کی اور پھر بیان حلفی ہائی کورٹ میں جمع کروا دیا۔ عدالت نے جج کو معطل کر کے خدمات لاہور ہائی کورٹ کو واپس کر دیں اور ان کا بیان حلفی ریکارڈ کا حصہ بنا دیا۔
